Motionless Media Limited provides professional services across four key areas:

1. Graphic Design Services

2. Website Design Services

3. Local Search Engine Optimization (SEO) Services

4. Data and Analytical Consulting Services

 

These Terms and Conditions govern the use of our services. By engaging with Motionless Media Limited, you agree to these terms. Specific provisions for each service are outlined below. Please read carefully to ensure you fully understand your obligations and our commitments.

Scope of Work

• Motionless Media will provide design services as per the agreed brief and deliverables outlined in the proposal.

• Revisions are limited to 3 rounds unless otherwise stated in the contract.

 

Client Obligations

• The client must supply accurate and complete content, including images, text, and other assets required for the design.

• Delays in providing necessary materials may impact the delivery timeline.

 

Ownership and Usage Rights

• Final designs will be delivered upon full payment and are granted to the client for agreed-upon usage.

• Preliminary designs, drafts, and unused concepts remain the intellectual property of Motionless Media unless specified otherwise.

 

Payment and Refunds

• A 50% deposit is required before work commences.

• Refunds will not be provided for work already completed.

• Deposits are non-refundable.

Scope of Work

• Website design services include layout creation, development, and testing as outlined in the project brief.

• Any additional features outside the agreed scope will incur extra charges.

 

Client Responsibilities

• The client must provide all necessary content, including text, images, and branding materials, by the agreed timeline.

• Approval delays may extend project timelines.

 

Ownership and Maintenance

• Upon full payment, ownership of the website design is transferred to the client.

• Ongoing maintenance and updates are not included unless explicitly agreed upon in the contract.

 

Payment and Termination

• A 50% deposit is required to initiate the project.

• Projects terminated by the client before completion will incur charges for work completed up to that point.

• Deposits are non-refundable.

Scope of Work

• SEO services include keyword research, on-page and off-page optimisation, Google My Business management, and analytics reporting as specified in the service agreement.

 

Performance and Results

• While Motionless Media strives to improve search engine rankings, we do not guarantee specific ranking positions due to factors beyond our control.

 

Client Responsibilities

• The client must provide access to relevant accounts, including website CMS and analytics platforms.

• Regular communication and approval for strategy changes are required to ensure effective service delivery.

 

Payment and Termination

• SEO services are billed on a monthly basis.

• Early termination requires 30 days’ notice, and fees for the current period remain payable.

Scope of Work

• Services include data collection, analysis, and strategic recommendations tailored to the client’s business objectives.

 

Confidentiality

• Motionless Media will handle all client data with the utmost confidentiality and comply with data protection regulations.

• Any sharing of client data with third parties will require prior written consent.

 

Client Obligations

• The client must provide accurate and complete data sets for analysis.

• Failure to provide necessary data may affect the quality and timeliness of the deliverables.

 

Payment and Deliverables

• Consulting fees are outlined in the service agreement and must be paid as per the agreed schedule.

• Deliverables will be provided in the format specified in the agreement.

Confidentiality

• Both parties agree to maintain the confidentiality of proprietary information shared during the engagement.

 

Liability

• Motionless Media Limited is not liable for indirect, incidental, or consequential damages arising from the use of our services.

 

Payment Terms

• Invoices must be paid within 30 days of issuance. Late payments may incur interest charges.

 

Termination

• Either party may terminate the agreement with written notice. Any fees for work completed remain payable.

 

Governing Law

• These Terms and Conditions are governed by the laws of England & Wales.
